Terms & Conditions for Event Participants

1.) Application of these Terms & Conditions

1. These terms and conditions (hereinafter referred to as “T&C”) govern the contractual relationship between WeAreDevelopers (“we”, “us”, “our”, WeAreDevelopers GmbH in Austria or WeAreDevelopers Germany GmbH in Germany depending on the event you are registering for) and event participants (“the Participant”, “you”, “your”).
2. The subject matter of these T&C is the purchase of tickets for the event specified in the event registration form (the “Event”) and the participation at the Event by the Participant.
3. By submitting your registration, you expressly agree to these T&C.

2.) Website Terms of Use and Privacy Policy

1. The Terms of Use, which describe the terms and conditions for the usage of the Website, are a substantial part of these T&C. If any provision of the Terms of Use is in contradiction with these T&C, then the respective provision of these T&C shall apply.
2. The Privacy Policy of WeAreDevelopers is a substantial part of these T&C.
3. Both documents are published and available on the Website.

3.) Registration to Events / Purchasing of Tickets

1. Tickets for the Event are exclusively sold directly by WeAreDevelopers through our website (www.wearedevelopers.com) or through our ticket purchasing provider (stated on the website). We are not liable for any tickets purchased from third parties.
2. The purchase price is due at the time when the tickets are purchased.
3. Once a successful purchase transaction has been completed, tickets are delivered in electronic soft-copy via email to the email address nominated by the purchaser. For some ticket types it may be necessary to complete required information – such as the attendee name or tax identification number – before the tickets can be issued. The ticket acts as a receipt for the transaction and can be used to redeem entry at the event listed on the ticket. A printed hard-copy ticket or an electronic soft-copy ticket detailing the reference number can be used to register for the event.
4. You are solely responsible for safe-guarding your tickets. We don’t assume any liability for lost or stolen tickets.
5. Your ticket grants you access to the Events and services as specified for the ticket category you have purchased.

3.) Code of Conduct

1. By purchasing a ticket to the Event, you expressly agree to comply with the Code of Conduct outlined on the respective Event website. Violations of the Code of Conduct may result in expulsion from the Event without any further liability by us and without any obligation to refund any amounts to you.

4. ) Refund Policy

1. We do not offer refunds for purchased tickets. Once purchased, tickets and any inherited registration fees are non-refundable.

5.) Check-in / Access to the Event

1. In-person events: In order to enter the event venue and participate in the Event, you will need to perform a check-in at the respective check-in stations at the venue. You will need to present your ticket by providing a hard copy or by using a digital version of your ticket.
2. Virtual events: To access a virtual event, you will need to log-in to the event platform using your personal access code. This access code will be provided to you shortly before the virtual event starts.
3. In the case of concession rate tickets (e.g. student tickets, startup tickets, or similar) we may ask you for proof of eligibility before you enter the Event. If you cannot provide such proof, we reserve the right to refuse entrance to the Event without any further liability and without the obligation to refund any amounts to you.
4. We may ask you to present your ticket and proof of identity at any time during the Event. If you fail to do so, we reserve the right to restrict your access to the Event without any further liability to you and without the obligation to refund any amounts to you.

6.) Transfer Tickets / Name Changes

1. If you can no longer attend the Event, you may send as a transfer request to tickets@wearedevelopers.com until 7 days before the commencement of the Event. Usually, transfers of tickets are free of charge, but we reserve the right to ask for a transfer fee in specific cases. 
2. Name changes will be facilitated free of charge and can be requested via email to tickets@wearedevelopers.com. No name changes will be facilitated 7 days prior to the commencement of the Event.

7.) Complaints

1. Complaints can be made to tickets (at) wearedevelopers.com. We will endeavor to resolve any complaints where reasonable.

8.) Photo and Video Policy

1. By participating in the Event, you acknowledge and agree that you may be photographed or video recorded by us or our affiliates.
2. You expressly agree and give WeAreDevelopers and its affiliates the perpetual right and permission to take pictures, video recordings, photographic portraits, or similar at the Event and to use such material for promotional and archival purposes through any media (online, print, television, radio, or similar) and without any liability or compensation.
3. The commercial use of photos or videos taken at the Event by the Participant is strictly prohibited and only possible with our prior written approval.

9.) Warranty and Limitation of Liability

1. WeAreDevelopers does not assume any warranty that the Participant’s expectations of the purchased services are met. 
2. The Participant shall have no claims for damages against WeAreDevelopers of whatever type, irrespective of the legal basis therefore, unless these claims are based on culpable loss of life, bodily injury, impairment of health, intent, gross negligence or culpable violation of a cardinal obligation by us or by any of our legal representatives, employees or vicarious agents.
3. In the case of claims for damages in connection with violation of cardinal obligations that are not based on intent or gross negligence on our part or on the part of any of our legal representatives, employees, or vicarious agents, our liability is limited to the foreseeable amount of damage or loss that is typical of the contract.
4. To the extent that our liability is limited or excluded, these rules shall also apply to the personal liability of our legal representatives, our employees and vicarious agents.
5. The liability for slight negligence of WeAreDevelopers, except for personal injuries, shall be excluded.
6. WeAreDevelopers is not liable for not complying with contractual duties or provisions, if the reason for non-compliance is due to circumstances beyond the control of WeAreDevelopers. This applies particularly to the cases of force majeure.
7. WeAreDevelopers shall not be liable for any direct, indirect and consequential damages, in particular, but without limitation to, lost profits and third party claims arising out of or in connection with the Event or our services.
8. The Participant acknowledges that according to the state of technology there is no process to guarantee error-free execution of an Event or other services.
9. No liability shall be assumed for correctness and completeness of any information on the website of the Event. WeAreDevelopers takes no responsibility and assumes no liability for any information / content that is posted, stored, uploaded, shared, or transmitted via the website or at the Event, or for any loss or damages that may occur because of such information / content including, but not limited to defamation, slander, libel, falsehoods, obscenity, or profanity.
10. WeAreDevelopers shall not be liable for any kind of abuse of data or information by either the Participant or third parties.
11. Further, WeAreDevelopers shall not assume any liability for system failures, disturbances, data loss and viruses resulting from external attacks or any other reason.
12. The Participant is obliged to indemnify and hold WeAreDevelopers harmless against any third party claims resulting from the use of our services or the Participant’s participation at the Event.
13. Any and all claims asserted against WeAreDevelopers by the Participant shall lapse three months after such claims arise, irrespective of the time at which the Participant becomes aware thereof.

19.) Visa

1. WeAreDevelopers will not be liable for the granting of any visas that are required to attend the Event. In the event that an attendee’s visa is not granted tickets will not be refunded.

11.) Changes to the Event / Postponement / Cancellation / Force Majeure

1. WeAreDevelopers reserves the right, at its sole discretion and without liability, to change the Event format, agenda, content, speakers, topics, venue location, timings, technical and administrative details and any other aspect of the Event at any time and for any reason. This includes the right to change the Event from a physical event to a virtual event and vice-versa.
2. The Participant acknowledges that such changes may be required for the benefit and safety of the Event and the Event participants as a whole (e.g. in order to ensure public health or safety or if the organization of the Event would be impracticable, illegal or impossible).
3. In case the Event is being cancelled, relocated or postponed to another date for reasons other than a Force Majeure event, we may offer you the option of participating at the rearranged or rescheduled or any other Event we choose to organize. If you promptly, and within 14 days after being informed by WeAreDevelopers about the rearranged or rescheduled event, notify us in writing that you do not wish to participated in the rearranged or rescheduled event, then you will be entitled your existing Ticket, including all registration fees, as credit for a future event hosted by WeAreDevelopers. 
4. Force Majeure: WeAreDevelopers shall be relieved of its obligations if the Event or parts of it cannot be performed or the Event needs to be changed or terminated due to reasons or failure which result from anything beyond the reasonable control of WeAreDevelopers (e.g. extreme weather, flood, fire, terrorism, war, pandemic, governmental acts, risk to public health, etc.) or anything that would make a performance of the obligations illegal or impossible. In the event of force majeure, WeAreDevelopers shall be under no obligation to refund any tickets or fees. WeAreDevelopers shall be under no liability to the Participant which may result thereof.
5. If a Force Majeure event has an impact on the performance of the Event, the ability to hold the Event at the planned venue location or the planned event dates, WeAreDevelopers shall be, at its sole discretion and without obligation, entitled to either (i) provide an alternative event location (ii) reschedule the Event to a later date (iii) hold the event as virtual event. In such case, any tickets and registration fees will be applied to the rearranged or rescheduled event and you shall not be entitled to object such rearranged or rescheduled event or have any right to claim any compensation in respect thereof. If we are unable or if we elect not to rearrange or reschedule the Event, you are entitled to transfer your ticket and any registration fees to an upcoming event hosted by WeAreDevelopers.
6. WeAreDevelopers will use reasonable endeavors to inform the Participant of any changes to the Event which have an impact on the Participants rights under this T&C.
7. You acknowledge and agree that the provisions under this clause set out your sole remedy should the Event be changed, postponed or cancelled, and all other liability of WeAreDevelopers is expressly excluded.
8. WeAreDevelopers is not responsible for any loss or damage as a result of a substitution, alteration, cancellation or postponement of an event. 

12.) Intellectual Property

1. You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all material or content contained within the Event website and at the Event shall remain at all times owned by us, our licensors or the respective owner of the IP. You are permitted to use this material only as expressly authorized by us, our licensors or the respective owner of the IP.

13.) General Clauses

1. WeAreDevelopers shall be entitled to delegate its obligations under this T&C to its affiliates or third-party suppliers in order to perform the Event and services for the Event.
2. No other terms shall apply and these T&C contain the entire agreement and understanding between the Participant and us in respect of all matters which are referred to herein and supersede any prior, written or oral agreement between the Participant and us relating to such matters. You confirm that in agreeing to accept these terms you have not relied on any representation that is not expressly included herein and you agree that you shall have no remedy in respect of any misrepresentation which has not become a part of these terms. 
3. If any part of the T&C herein shall be deemed unlawful, void or for any reason unenforceable then that provision shall be deemed to be severable from these terms and shall not affect the validity and enforceability of any of the remaining provisions of the terms.

14.) Place of jurisdiction

1. All legal disputes which may arise out of or in connection with these T&C and the legal relationship between WeAreDevelopers and you shall be governed by and construed (i) under the laws of Austria and with jurisdiction by the respective court in Vienna if the Event takes place in Austria, or (ii) under the laws of Germany and with jurisdiction by the respective court in Berlin if the event is the WeAreDevelopers World Congress, without giving effect to its conflict of law rules and UN Sales Convention.
